UPC: Local Chamber Mannheim Affirms Jurisdiction for Pan-European Online Offers

In this jurisdictional decision, the Local Chamber Mannheim addresses the scope of its competence regarding online offerings and defendants located outside the European Union. The defendants were resident either in the Netherlands or outside the European Union. The Court affirmed both the international jurisdiction over a defendant resident outside the European Union pursuant to Article 31 of the Unified Patent Court Agreement in conjunction with Article 7(2) and Articles 71a, 71b of the Brussels Ibis Regulation, and the substantive jurisdiction under Article 32(1)(a) of the Unified Patent Court Agreement, as the action sufficiently alleged infringing acts against all defendants; their actual involvement was to be clarified only in the main proceedings. For the internal allocation of jurisdiction under Article 33 of the Unified Patent Court Agreement, a coherent assertion that infringing acts had occurred or were imminent in Germany, for example through pan-European online offers of the attacked products, is sufficient.
