UPC Local Division: Service

The defendant was informed of the service on 10 March 2025, the statement of claim was made available for collection at a branch of the German Post, he did not collect it within the following two weeks and did not inquire about it with the German Post later either. The acceptance of the letter was therefore refused. A notification pursuant to R 271.8 RoP was not filed. The statement of claim is therefore deemed to have been served on the defendant on the 10th day after being posted (4 March 2025), i.e. on 14 March 2025, in accordance with R 271.6(b) (LK München 14. 4. 2025, CFI 119/2025).
