UPC-Court of Appeal: Procedural decision on the extension of the time limit for the Statement of grounds of appeal

The defendants’ representatives request that the deadline for lodging the Statement of grounds of appeal be extended by two weeks, as the patent attorney handling the case is unable to devote the necessary time and resources to prepare the grounds of appeal due to various professional constraints, including business travel by team members and a two-day oral hearing before the EPO. Taking into consideration the two-day oral hearing that one of the lead attorneys has to attend at the EPO, which is scheduled to take place precisely at the time the deadline for filing the Statement of grounds of appeal expires, and considering that a time extension for filing said grounds of appeal would not prevent the enforcement of the impugned order, it is justified, by reference to the principles of due process, that the appellants may exceptionally be granted a time extension which shall be limited to three working days (CoA 24.9.2025, CoA: pending).
