UPC Court of Appeal: Further Pleading

The written procedure before the Court of Appeal is limited to the submission of a statement of grounds of appeal and a statement of defence in appeal proceedings. Additional grounds of appeal that are not submitted within the time limit provided for in R 224.2 RoP are not admissible. A further exchange of pleadings is therefore not foreseen, unless a cross-appeal has been filed in accordance with R 237 and R 238 RoP. Before the conclusion of the written procedure, a further exchange of pleadings may be permitted upon reasoned request by a party, under the conditions set out in R 36 RoP, which apply mutatis mutandis to the appeal procedure (UPC 24. 3. 2025, CoA 835/2024).
