UPC Court of Appeal: Acceleration of appeal proceedings

In an appeal under Rule 302.1 of the Rules of Procedure (RP) concerning an order that proceedings brought by multiple plaintiffs or in respect of multiple patents be heard in separate proceedings, a request by the petitioner, filed on the last day of the time limits for filing the notice of appeal under R. 224.1(b) and the statement of grounds of appeal under R. 224.2(b) RP, for shortening the time limit under R. 9.3(b) RP for the filing of the statement of defense was rejected in view of the interests of the appellee and the principles of due process, even if this may mean that in the proceedings before the Court of First Instance the statement of defense must be filed before a decision has been rendered in the appeal proceedings (UPC 22. 02. 2024, CoA 36/2024).
