Workability with open-ended parameter ranges in a claim
Where the claimed invention contains a physical parameter having an open-ended range in one direction that cannot be reproduced on the basis of common general knowledge together with the rest of the invention, the range can still be regarded as reproducible over the whole claim breadth if the description (at least implicitly) shows that the skilled person, by practising within certain essential structural and/or process features defined in the claim, would be able, without undue burden, to adjust the parameter so as to obtain different values within the open range (EPO BoA 13 Nov 2024, T 1977/22, Open-ended ranges/RHODIA).
