Launch of Unitary Patent and the Unified Patent Court delayed

The roadmap published by the Unified Patent Court (UPC) for the entry into force of the Agreement on a Unified Patent Court (UPCA) has been delayed. According to a new announcement, the start date will be postponed from 1 April 2023 to 1 June 2023, with the additional time needed for preparations related to authentication for the court's Case Management System.

Under the new schedule, the three-month sunrise period will begin on 1 March 2023. From 1 June 2023, it should be possible to obtain European patents with unitary effect ("Unitary Patents") and to bring actions before the UPC.
